Federal judge in Texas rules Obama health-care law unconstitutional

This evening, as the Affordable Care Act's enrollment period ended, Judge Reed O'Connor of the U.S. District Court for Northern District of Texas issued his much-awaited opinion in Texas v.

House Republicans managed to pass an Obamacare repeal proposal known as the American Health Care Act (AHCA); however, Senate Republicans failed to pass multiple Obamacare repeal proposals during this congressional term.

'Without [the individual mandate], Congress and the Supreme Court have stated, the architectural design fails, ' according to O'Connor.

As the foregoing makes clear, I've been highly skeptical of the claims in this case from the beginning. No matter how O'Connor ruled, legal experts have been forecasting that the Texas case would be appealed and could well place the law again before the high court, giving its conservative newest member, Justice Brett Kavanaugh, a first opportunity to take part.

O'Connor said that because the individual mandate is "essential" to the rest of the ACA, all of Obamacare is invalid.

President Trump applauded the decision on Twitter Friday night, writing that he had "predicted all along" that the Affordable Care Act is unconstitutional. President Trump has vowed since his campaign to dismantle the law, a main domestic achievement of his predecessor, and the administration has been taking steps on its own to foster alternative insurance that tends to be less expensive because it skirts ACA requirements. Mitch and Nancy, get it done!'

As part of a tax overhaul a year ago, congressional Republicans pushed through a change in which that ACA penalty will be eliminated, starting in January.

On Friday, Henneke said the judge made the right decision, although the judgment will nearly certainly be appealed.

The decision was a break with a long-standing executive branch practice of defending existing statutes in court.

Twenty Republican-led states, including Kansas, brought the lawsuit.

"The Supreme Court held Obamacare was only tethered to the Constitution by a very thin thread - the fact that the individual penalty raised some revenue", Paxton said in a prior statement.

"Today's decision is an unfortunate step backward for our health system that is contrary to overwhelming public sentiment to preserve pre-existing condition protections and other policies that have extended health insurance coverage to millions of Americans", said Dr. Barbara L. McAneny, president of the American Medical Association.
