The choice could be made all the more hard for Casey if Trump nominates Thomas Hardiman, now serving as a judge on the 3rd Circuit Court of Appeals which covers part of Pennsylvania, and who was first appointed to serve in U.S. District Court in Pittsburgh in 2003.

Democrats in the past also have pointed to Kavanaugh's work for Bush during the recount fight in the pivotal state of Florida in the 2000 presidential election, a controversy that was resolved only after the conservative-majority Supreme Court sided with Bush over Democratic candidate Al Gore, settling the election outcome.

The appointment is seen as crucial because Kennedy was often a swing vote who would sometimes side with the court's four conservative justices and at other times with its liberals.

Hatch, who has participated in the confirmation hearings for 15 justices, including all nine now on the high court, says any one of the four would make a good justice. The White House said Monday that former Sen. But there's one qualification that could prove a problem for the judge: his ties to the Bush family have reportedly raised Trump's suspicions.
