Tough New Kenya Law To Curb Fake News

President Uhuru Kenyatta early today signed the Computer and Cybercrimes Bill, 2017, which criminalises among other things the posting of fake news on social media.

The signing of Computer Misuse and Cybercrimes Bill, 2018 took place at State House in Nairobi on Wednesday.

Violations to be penalized under the law include cyber-espionage, false publications, child pornography, computer-borne forgery, cyber-stalking and cyber-bullying among others, the statement said, without spelling out the penalties.

Although punishments for some of the detailed offences are reasonable, retribution for crimes of fake news - under Clause 12 of the Bill - can potentially inconvenience the media including online journalists, social media influencers and bloggers.

According to the Kenyan presidency, the Government is going to establish a National Computer and Cyber crimes Coordination Committee.

National Assembly Speaker Justin Muturi presented the Bills and witnessed the signing alongside Deputy President William Ruto, Interior Cabinet Secretary Fred Matiang'i, National Assembly Majority Leader Aden Duale, Attorney General Paul Kihara Kariuki and Solicitor General Kennedy Ogeto.

The clause says if a person "intentionally publishes false, misleading or fictitious data or misinforms with intent that the data shall be considered or acted upon as authentic", they can be fined up to 5 000 000 shilling (nearly R620 000) or imprisoned for up to two years.
