Family files lawsuit over lost embryos at University Hospitals

Centers refrigerator malfunctioned a temperature fluctuation that affected hundreds of eggs and embryos

The hospital hasn't said whether it would compensate about 700 affected patients, who are being notified through letters and telephone calls.

"There is just not an ability to do this unemotionally".

Tipton said he was unaware of similar malfunctions that damaged thousands of eggs and embryos.

On Sunday, the Pacific Fertility Clinic released a statement to CBS San Fancisco saying, "A single piece of equipment in our cryo-storage laboratory lost liquid nitrogen for a brief period of time".

"Our patients and the safety of their eggs and embryos are our highest priorities and we are reaching out to inform them of this incident". He said that the clinic's staff thawed a few eggs and found that they remain viable, though they do not know how many are still usable. Dr. Carl Herbert, president and medical director at the Pacific Fertility Center in San Francisco, told ABC News that in his 35 years of Cryopreservation it is an "an unusual event" where two clinics and two liquid nitrogen storage tanks where the tissues are stored "failed". Embryos - fertilized eggs - are stored individually.

Clinic spokesman Alden Romney told the Post the eggs and embryos from the troubled tank represent as much as 15 percent of the total stored at the facility.

The clinic declined to specify the number of eggs and embryos affected but said that "several thousand" were in the waist-high tank.

Herbert told the Post, "This was a awful incident, but I was reassured that".

The clinic has reported the incident to the College of American Pathologists, which regulates labs, and the overseers of California's tissue banks, Herbert said. "We have brought in independent experts and are conducting a full investigation".

According to the Pacific Fertility website, egg-freezing costs $8,345 for the first round and $6,995 for each subsequent round.

"With two apparently happening on the same day, we have to find out what other types of commonalities there were", he said.

There was increased security at University Hospitals Ahuja Medical Center Friday night.

An Ohio family has filed a class action lawsuit against the hospital where officials estimate about 2,000 frozen eggs and embryos may have been damaged by a storage tank malfunction. Some dated to the 1980s.

"Our clients are absolutely devastated, as I'm sure countless families across OH are, in the wake of this catastrophic failure by University Hospitals", said Mark DiCello of DiCello Levitt & Casey, attorney for the plaintiffs.
