Supreme Court Collegium recommends nine new judges for Madras High Court

Collegium

The Supreme Court collegium comprising CJI Dipak Misra and judges - Justices J Chelameswar and Ranjan Gogoi - considered the names of 25 advocates and cleared 19 for the Karnataka, Madras and Calcutta high courts.

On October 31, the senior counsels of Advocates Association of Bengaluru also passed a unanimous resolution threatening a hunger strike if the appointment of judges was not made before December 15.

The case of advocate B Pugalendhi for elevation to the Madras High Court bench has been deferred in the light of "certain adverse but unconfirmed inputs" received by the Collegium, and it would wait to get the inputs verified before taking a final decision in the case.

The names were put forward by the chief justices of the high court in consultation with their two senior-most colleagues. It also approved elevation of 19 lawyers to three High Court benches, including five to the Karnataka High Court, overruling the chief minister's objections.

Notably, Karnataka Chief Minister Siddaramaiah has "conveyed his disagreements" with the 10 names selected by the high court's collegium. The judges noted that while recommending extension of his term as additional judge the Karnataka HC collegium "has not placed on record any material for not recommending him for appointment as permanent judge, though a permanent post is available". The governor had mentioned that some of the people recommended did not meet the requirement of efficiency in their performance.

After three years, five lawyers have been recommended for elevation as judges of the Karnataka high court.

The collegium rejected the name of Advocate Piush Chaturvedi as "his average professional income is well below the prescribed minimum professional income limit". Recommendation of one lawyer was rejected on the grounds he did not qualify the "income criterion". Those slated for elevation are Subramonium Prasad, PT Asha, Senthilkumar Ramamoorthy, GK Ilanthiraiyan, C Emalias, C Saravanan, N Anand Venkatesh, M Nirmal Kumar and Krishnan Ramaswamy.

A lawyer recommended by the Karnataka HC collegium was found "unsuitable" while names of four others were sent back to the HC for reconsideration.

The Supreme Court Collegium has recommended nine advocates for appointment as judges in the Madras High Court out of a total list of 11 submitted before it.

As first reported by DNA, the Supreme Court met on Monday to take up the names recommended by the HC collegiums and which had been pending as long as over one year.

Among those who were made permanent judges include justices Sandeep Sharma and Chander Sharma at the Himachal Pradesh High Court, Justice Narendar G at the Karnataka High Court, justices Ananda Sen and Anant Bijay Singh at the Jharkhand High Court and Justices Sanjay Agrawal and Rajendra Chandra Singh Samant at the Chhattisgarh High Court.
