Centre to end 'Triple Talaq' in upcoming winter session

After the controversial triple talaq row, the Centre is now planning to implement a rule by bringing a legislation to it in the upcoming Parliamentary Winter Session.

Government sources said on Tuesday that the government had set up a ministerial panel and will either bring a new law or amend existing provisions to ban talaq-e-biddat and punish those practising it.

In a landmark judgment, the Supreme Court had in August earlier this year struck down the centuries-old practice of instant triple talaq among Indian Muslims as unconstitutional, manifestly arbitrary and void in law.

The judgment upholds equal rights and equal protection of every person enshrined under Article 14 of the Constitution, irrespective of majority or minority status.


Soon after the SC judgement, the government said that a law on triple talaq might not be necessary as the order was now the law of the land.

Centre felt that this is happening because of two reasons. In spite of reaching out to the members of the community to stop this archaic practice, there seems to have been no decline in the practice of Talaq-e-biddat, Centre noticed. "It could also be because of lack of deterrent punishment for the act of Talaq-e-biddat", a government official was quoted as saying by the Economic Times. Subsequently the wife approached the police.

Many Muslim countries have banned triple talaq, including Pakistan and conservative Saudi Arabia.

The apex court had directed the government to draft and frame a law outlawing the practice, where Muslim men could give unilateral divorce to women, merely by pronouncing the word 'talaq' thrice. Even police are helpless as no action can be taken against a husband giving triple talaq in the absence of punitive provisions in the law.
